Terms and Conditions

Payment of Fees/Refunds/Event Cancellation

  1. Payment is due for each event at least one month before each event you are attending. Failure to pay on time may result in your place being given to another stallholder on the waiting list.
  2. Cancellation terms: Stallholders will be refunded 100% of their total pitch fee if they cancel their booking 31 days or more before an event date, 50% of their total pitch fee if they cancel their booking between 15-30 days prior to an event date. No refunds will be given in the event of cancellation 14 days or less before an event.
  3. Cancellation of the event:
    • If the organiser needs to cancel in advance of a scheduled event date, we the organiser(s) will endeavour to contact traders with as much notice as practicable.
    • If the event has to be cancelled for safety reasons outside of our control (such as adverse weather conditions or unforeseen site emergencies like a burst water pipe or sewer problem), where it may not be possible to give a significant period of notice or a decision is taken for the event to be cancelled on the morning of the event, any pitch fees will be carried over to the next scheduled event. Where stallholders are unable to make the next scheduled event, we the organisers will issue a refund.
    • The venue and Boom 7 will not be liable for any loss of earnings incurred through cancellation.

Criteria for Participation

  • Priority will be given to stallholders who sell produce which has been locally grown, raised, caught, baked or produced within the borough of Milton Keynes and adjoining counties.
  • The organisers reserve the right to decline stallholders if felt that their wares will take trade away from products already on sale at the venue.
  • Your business must comply with all local and national laws, regulations and codes of practice regarding the production, labelling, display, storage and sale of goods.
  • A copy of your public liability insurance must be provided to confirm your pitch offer in the first instance.
  • Stallholders participate in the event entirely at their own risk in every respect and shall indemnify the event organiser(s) from liability for personal injury, loss or damage to property by their own actions or omissions to maximum extent permitted by law.
  • Stallholders shall be solely liable for and indemnify the event organiser(s) against all loss, damage, claims or demands (other than for any death or personal injury caused by the negligence of the event organiser(s) or any of its employees or agents) which may have been caused directly or indirectly by the stallholder, their equipment and stock, or their employees or agents.
  • The stallholder must be either involved in the production process or be fully conversant with the process behind the manufacture of the produce and its origins.
  • Whilst exclusivity cannot be guaranteed for stalls, every effort is made to ensure a good balance of goods and services on offer to the public at each event, with acceptance of any stall application being at the discretion of the event organiser(s).
  • The organiser(s) has a strict no duplication policy meaning no stall is allowed to add any produce to their stall that is already being sold on another stall and was not declared prior to the event.
  • The sale of items deemed not to be in keeping with the spirit of the event is prohibited. The event organisers retain the right to turn away or ask to leave any stallholder found to be in contravention.

Health and Safety

  • All traders are reminded of their legal duties to ensure that work activities are carried out in such a way that other people at work and members of the public are not exposed to risks to their health and safety. Advice on managing health and safety at work is available on the HSE website at www.hse.gov.uk
  • All incidents, accidents or near misses must be reported immediately to the event organiser(s) representative on site.
  • Smoking is not permitted by traders, their employees and suppliers on site in accordance with the 2006 legislation which bans smoking in enclosed/substantially enclosed workplaces and public and is only permitted in the designated staff smoking area.
  • Stallholder(s) are wholly responsible for hygiene practices, including the provision of hand sanitiser, and the handling and safety of their own equipment to ensure there is no risk to the general public.

Electrical and Gas Safety

  • A risk assessment for the use of electrical and gas equipment must be in place, and where requested a copy provided.
  • All electrical equipment used on the stall must be PAT Tested (Portable Appliance) for electrical safety.
  • Stallholders are not permitted to use electrical heaters.
  • Stallholders must ensure that any gas/LPG appliance, installation, pipework or flue in use at the event is maintained in a safe condition so as to prevent risk of injury to any person, with annual servicing provided by a Gas Safe registered engineer in order to ensure that appliances continue to operate safely. The engineer’s report must be retained and produced upon request.
  • In respect of use of gas cylinders (bottle gas), stallholders must have with them a certified fire-extinguisher.

Food Safety and Hygiene

  • All food-based traders must be registered as a food business with their Local Authority.
  • Food businesses must comply with all current food safety and food hygiene legislation.
  • As a food and drink supplier, the Local Authority may visit to carry out an inspection without any prior notification to inspect food operation, the management of food hygiene and to check that the business is complying with food hygiene laws. You may be asked, at any time, to present your registration and/or insurance details.
  • Basic food hygiene certification is required for handling and selling food and drink products.
  • Please be aware of the regulation changes as per Natasha’s Law. It is your responsibility to ensure all your products are labelled correctly.

Event Organisation

The following points outline how the event is organised. By your participation in the event, the venue and Boom 7 will assume you have agreed in this respect and abide by these arrangements. Failure to do so may affect your participation in the event.

  • No stallholders to arrive before the set-up time communicated via email prior to the event.
  • All vehicles must be removed from the event area at least 15 minutes before the published start time of the event and parked where instructed by the organiser.
  • Stalls must not be cleared away before the published end time of the event without the prior agreement of the event organiser(s).
  • In the event of you being unable to attend on the day we ask you let the event organiser(s) know at the earliest opportunity possible using the mobile phone numbers given in the event details email.
  • Produce must be well presented and displayed and must be of good quality with stallholders undertaking to have exhibits on display for the duration of the event.
  • There is a No Dogs policy for those stalls selling food.
  • Stallholders must be mindful of the need for health and safety whilst setting up and throughout the duration of the event.
  • Stallholders must provide their own tables and not build out beyond their allocated space so as to impact adjacent stalls or movement of the public.
  • All wires, cables and ropes are to be set up with no overhangs or trip hazards. Those that may cause a trip hazard are to be covered with matting or securely taped, not to do so may lead to requests to remove such hazards.
  • Stallholders should display trading names clearly on their stalls, together with appropriate contact details.
  • Stallholders must keep their allocated space clean and tidy, and must dispose of all their rubbish by taking it away at the end of the event.
  • The allocation of stalls is solely at the discretion of the event organiser(s).
  • Each event is run as a separate event.
  • Any incident, accident or near miss involving a member of the public which has occurred as a direct result of their visit to an event stall must be reported to the event organiser(s) representative on site.
  • Stallholders acknowledge that the venue owns the site and its fixtures, hard and soft landscaping, and to respect the property so owned.
  • Stallholders must not commit any nuisance or do any act or thing which will intentionally bring the event or the integrity of the venue into disrepute or cause nuisance to surrounding businesses or residents.
  • On the day of the event, the organiser(s) representative on site should be considered the contact for the purposes of these rules and regulations. If you wish to make a complaint or have an issue with the event, please contact the event organiser(s) representative on site.
